Are Alabama’s Rural Motorists Aren’t Using Seat Belts?

uber accident boston 300x200 Are Alabama’s Rural Motorists Aren’t Using Seat Belts?
Rural motorists are three to ten times more likely to die in car crashes than urban motorists because they don’t use safety belts.

Mobile, AL- Some drivers are adamant about using a safety belt and wouldn’t think about driving anywhere without buckling up. Regrettably, not all motorists are using their seat belts and are putting themselves in grave danger. A recent study shows that motorists in rural areas are less likely to wear seat belts than urban passengers and drivers.

Study Says Rural Drivers Aren’t Buckling Up

In a recent study, the Centers for Disease Control and Prevention found drivers in rural areas are three to ten times more likely to die in road accidents. While a variety of reasons contribute crash rates, the CDC says failure to use safety restraints is the primary cause of deadly rural crashes.

The CDC found that in fatal crash rate in urban areas in the South is 6.8 deaths per 100,000 motorists. That significantly lowers the rural crash rate of 29.2 deaths per 100,000 motorists. Over sixty percent of drivers in fatal rural crashes were not properly restrained as opposed to just 44.3 percent of urban motorists.

There Are Many Reasons to Wear a Seat Belt

There is an extensive list of reasons to wear a seatbelt, here are a few:

You have more than a 50 percent chance of being in a fatal or injurious accident at least once in your lifetime.

Most traffic crashes occur within 40 miles of the victim’s home.

Traffic crashes are the leading cause of death for resident’s aged 1-34, according to the Alabama Department of Public Health.

accident lawyers 300x200 Are Alabama’s Rural Motorists Aren’t Using Seat Belts?
Ninety percent of motorists in Alabama wear their belts.

For adults, seat belts reduce the risk of suffering fatal injuries by 45 percent.

Car seats and restraints reduce the risk of death in children by 54 percent and 74 percent for infants.

90 percent of Alabama motorists wear a seat belt which is higher than the national average of 86 percent, the CDC reports.

It’s the Law

Under Alabama law, all front seat occupants are required to wear a seatbelt. Violators must pay a $25 fine.

Are Accident Victims Penalized for Not Wearing a Seat Belt?

Safety-wise it’s always smart to wear your seat belt, but there is also a legal reason to buckle up. If you file an injury claim, you could get a smaller settlement if you weren’t restrained. Even if someone else is at fault for your crash, the defendant can argue that your lack of safety restraints made your injuries worse. That can result in a 10 to 20 percent cut in your accident settlement.

Accident Victims Need Legal Representation

You need legal representation if a negligent driver injures you. Hurricane Irma’s Aftermath Has Led to Some Tragic Accidents in Florida

As everyone seems to be getting back into their normal daily routines after being impacted by the deadly Hurricane Irma that devastated several parts of Florida, unfortunate accidents are back on the rise. Several accidents have already been reported by various news source sites, some citing the deaths of innocent individuals.

The first accident that occurred was in Clearwater, Florida, which is only about an hour or so away from Lakeland, and it involved two boats which collided into one another. Boating accidents, just as auto accidents, can occur for a number of different reasons, however, we aren’t sure what was the cause of this one. According to The Ledger, 52-year old Craig Butz of Altamonte Springs was riding in the boat with a four-year-old girl when their boat collided into another traveler. The accident happened in the Intracoastal Waterway near Clearwater Beach.

Although the Florida Fish and Wildlife Conservation Commission is investigating the incident that occurred, Craig Butz did not survive the boating accident after being taken to a nearby hospital to be treated for his injuries. The young girl was flown to a St. Petersburg hospital, however, her name has not yet been announced.

More People Die in Accidents after a Hurricane Is Already Over

Palm Beach, FL – The actual hurricane is not what you need to worry about; more people die in accidents once a hurricane is over.

Before you run out to start cleaning up the mess Hurricane Irma left behind, you may want to wait a minute. Reports of storm surge, flooded streets, and traffic signs floating down the street are telltale signs that it’s not safe to go outside. But what about the most dangerous part of the storm: once it’s over?

According to a report by the director of the National Hurricane Center, Edward N. Rappaport, Atlantic tropical depressions, tropical storms, and hurricanes have killed almost 1,900 people in the United States from 2000 to 2014. Most would assume the fatalities were a result of accidents during the hurricane, i.e. flooding or wind; however, over half the deaths were caused by “indirect” factors, think fatal accidents during cleanup.

The National Weather Service defines direct deaths from hurricanes as fatal accidents that occur as a result of storm surge, flooding, and rip currents. Fatal accidents not caused by the weather are considered indirect deaths. The Washington Post reports that indirect deaths far outnumbered direct deaths for 70 percent of the past 10 hurricanes.

beach 768587 1920 300x175 More People Die in Accidents after a Hurricane Is Already Over
Have gotten into a hurricane-related accident in Palm Beach? Find a Florida accident attorney in your area today.

In fact, a study done by the Sun Sentinel discovered that debris cleanup accounted for a quarter of the 201 deaths reported during the 2004-2005 hurricane season. Some of the indirect deaths were caused by heart attacks from over-exertion, and falling off ladders, roofs, and trees while cleaning up after the hurricane.

But it doesn’t end there; records show that people who left storm shelters immediately after a hurricane passed oftentimes found themselves in a fatal accident. In total, there were 964 indirect deaths from the top 10 deadliest storms since 2000. Of those indirect deaths, 56 were from fatal car accidents, 32 were from accidents involving trees, 31 were from accidents in unlit stairwells, 27 were from electrocution, and 20 were from accidents with open flames.

Some storms cause different types of fatal accidents. In particular, 318 people died from cardiovascular ailments during Hurricane Katrina. Moreover, 15 of the 82 indirect deaths during Hurricane Sandy were because people kept generators in enclosed spaces, resulting in carbon monoxide poisoning.

Car Accidents in Florida During Hurricane Season

Hurricane season goes until November 30th this year, which means there may be plenty more storms heading our way. If you aren’t careful, hurricane-related car accidents can keep Florida accident lawyers busy all the way until 2018’s hurricane season.

Forecasters from the National Oceanic and Atmospheric Administration (NOAA) have predicted that the Florida will continue to see plenty of storm activity throughout the rest of the 2017 hurricane season.

How to Avoid Hurricane-Related Car Accidents in Florida

While the best way to avoid getting into a hurricane-related car accident is to stay inside at a safe location, you should still know how to avoid getting into a hurricane-related car accident:

  • Avoid driving over highway overpasses and bridges as these are most likely to suffer wind damage.
  • Do not drive through standing water.
  • Drive slowly and take your time; remember, getting to your destination safely is more important than getting there before everyone else.
  • Keep a strong grip on the steering wheel and have your headlights on at all times.

How Will Fault Affect an Auto Accident Claim?

Fault is one of the many things accident victims ponder on after a crash has occurred. Many wonder “Did I cause the accident?” “Did the other driver engage in an illegal action that led to this accident occurring?” or ” Why did this accident happen?”  It is natural to question who caused the accident as we generally want to be sure we know before we point the finger at ourselves.

The fact is, fault plays a major role in an auto accident claim. After all, the person who hit you should be responsible for paying for the damages caused right? Well, this isn’t always the case. You see, there are two types of insurance laws that states follow: at-fault and no-fault. When a state implements at-fault insurance laws, they generally require that the person found guilty of causing the accident covers the damages that resulted from the accident. In no-fault states, those who have sustained injuries generally receive compensation from their own Personal Injury Protection (PIP) insurance coverage, regardless of fault.

Is Georgia a fault state or does it follow no-fault laws?

photodune 7648841 liability concept xs 300x192 How Will Fault Affect an Auto Accident Claim?
Georgia follows at-fault laws which means those who are liable for causing an auto accident should be responsible for covering the damages they caused.

The state of Georgia follows at-fault insurance laws which means those who are found responsible for causing an accident are held accountable for compensating the accident victim for the damages brought on. While the at-fault driver’s insurance company will pick up these costs up to the limits stipulated in their policy, if the expenses go beyond that, the other driver may file a personal injury lawsuit to recover the remaining amount they feel they are entitled to.

If you were recently involved in an auto accident in Marietta, Georgia and are seeking legal aid to help you recover compensation for the injuries you have sustained, USAttorneys.com can help you locate a nearby accident lawyer in Marietta now. The skilled accident attorneys USAttorneys works with are capable of helping acknowledge fault if the insurance company isn’t identifying the right person and can get your claim filed in a timely manner.

What is used to determine fault in a car accident?

Police reports are an essential document insurance companies will use if one was written up. Police usually provide an accurate description of the accident and what role each of the parties involved played. Sometimes, however, certain information may be left out such as the initiator of the accident attempted to hit-and-run which should be noted on your claim.

Things like this can impact whether or not you or the other driver is found guilty of causing the accident. to be sure your auto accident claim is handled properly and fairly, allow an auto accident lawyer in Marietta, GA review the details of your matter. They can provide you with useful information regarding your recent accident as well as how much compensation your injuries and/or damages has entitled you to collect.

Cliff Jumping Accident Claims the Life of Arizona Man

On August 14, a man died after jumping off a cliff at Anchovy Point on Lake Powell, reports the Grand Canyon News. Erick Kallestewa of Hotevilla, Arizona, went to the point to jump approximately 30 feet into the water. The 25-year-old went under with the jump, but resurfaced shortly after. However, waves and the wind conditions caused him to struggle. Bystanders tried to help him, as did nearby boaters, but at one point he went under and did not resurface, according to witnesses.

The water around Anchovy Point is over 170 feet deep, and it was not simple to recover Kallestewa’s body. Officers from the Coconino County Sheriff’s Department and the National Park Service called in a remote operated vehicle to help with the search around the spot where he last went under. The search had to be suspended over night, but resumed the next day at dawn. His body was discovered by the ROV at approximately 10:45 that morning at a depth of 432 feet, according to police reports.

Cliff jumping is a pastime that’s been a hallmark of youth and excitement for as long as humans have lived near the water. However, as proven by this accident, it can be a deadly hobby if precautions are not taken. Not only should a jumper check the safety of the water and wind conditions, but debris in the water can be dangerous. The cliff itself can get slippery from wet feet climbing up and down, causing victims to slip and hit their heads on the rocks. Plus, jumping from high distances at the wrong angle, even into water, can cause broken bones and concussions.

Sometimes accidents happen that aren’t anyone’s fault. However, often accidents happen because of the negligence or even maliciousness of others. If you’ve been injured in an accident, or a loved one has died in an accident, there are steps you can take to make sure you can get compensation for things like hospital bills and lost wages. First, make sure you document everything, from the events leading up to the accident to what you and others did to treat injuries. Your injuries should be clearly documented as well through doctor notes and through your own photographs, if possible. Your first priority should always be healing and recovery, of course, but after that, your next step should be to contact a skilled attorney.

A skilled attorney can help in a number of ways after an accident. If insurance is involved and you get declined for coverage, a lawyer can prepare a case on your behalf and fight to have that coverage reinstated. If someone accuses you of being at fault, they can defend you in negotiations and in court. Finally, if you feel someone is at fault for your injuries, a talented attorney can file the necessary claims and fight in court for the compensation you deserve. Contact an attorney in Arizona today to get someone on your side.

Woman Wins Largest Personal Injury Lawsuit in Chicago History

A jury in Cook County gave the largest personal injury award in Chicago history yesterday reports the Chicago Tribune. A young woman is set to receive $148 million after being injured by a bus shelter during a storm in August of 2015. Tierney Darden of Vernon Hills sobbed as the decision was read by the judge. It took two years and a week-long trial to finally end this ordeal for the paralyzed woman. The city has not indicated yet whether it intends to appeal the decision.

Darden was a dance student in August of 2015. The then 24-year-old had just returned to Chicago with her mother and sister. They’d been shopping. There was a wedding coming up and they needed bridesmaids dresses. They were waiting outside O’Hare  airport for their ride in the middle of an August storm. A nearby pedestrian shelter was pulled off its moorings by the strong winds, and landed on top of Darden, paralyzing her from the waist down as it severed her spinal cord. She had been attending Truman College as a dance student.

It was revealed during the trial that there were bolts missing from the runaway shelter. An investigation found that several shelters at the airport weren’t maintained properly, and had issues with missing bolts, broken brackets, and corroded materials. It was because of these factors that the jury ruled in her favor. Chicago had already admitted that they were at fault, but the trial was to determine how much they should pay in damages.

It seems as if Darden must have done everything right to make sure she got the award that she deserved for the pain and suffering she has experienced. There are some things that can ruin a personal injury lawsuit, and it’s best to avoid them. For one, make sure that you give all the information you have to your attorneys and to the court. If you’re caught lying or omitting something important, then your credibility comes under suspicion. Also, avoid talking about the case on social media. If you post pictures that make it seem like you’re not as injured as much as you’re claiming, then your case would be in jeopardy. Also, if you are seen to be bragging or vindictive, it will put you in a bad light. Talking about settlement details can also completely invalidate a settlement, so it’s probably best to just not talk about your case at all with your friends and family on social media.

Another thing that can derail your case is choosing to represent yourself. You’d be facing off against an attorney with experience and a deep knowledge of the law. Getting a quality personal injury lawyer may cost more up front, but it will increase your chances of winning your case exponentially. They can file the claim for you, and if it comes to it, an attorney is the best choice to handle things in court. Call today for a consultation and to discuss your options.

Seniors Tour Originating in Bastrop Ends With Deadly Accident

What was supposed to be an exciting trip to the Gulf Coast to visit casinos ended in disasters for several Texas seniors. Four people died when a freight train slammed into their tour bus earlier this year. Seven more were critically injured, and 33 had less-serious injuries. Police were called in to investigate, according to the New York Post. From witness statements, it seems as though the bus was stuck at the crossing. The particular crossing on which it was stuck was on a steep hill. There are signs warning of low coverage, although it’s not known if that played a factor.  The accident happened in Biloxi, Mississippi.

After the accident, passengers were stuck amongst the wreckage, and it took over an hour to get everyone out. Two had to be cut out with special equipment. A passenger described what happened as a case of the bus trying to clear the tracks quickly, and then getting stuck “right in the middle.” The passengers worked to try to get out as the train was bearing down on them.

The bus had originated in Austin, but the trip had been organized by a seniors group in Bastrop. Passengers had been picked up from the Austin area, and were hopping from casino to casino. At the time of the crash, they were on their way to the Boomtown casino after a visit to the Hollywood casino. They had several more to visit throughout the rest of their trip, in addition to a trip to Louisiana.

Witnesses described a scene of horror before and after the train struck. Passengers were trying to get off, but once the train hit, some were pulled under the wreckage and some were run over by the train. As one witness put it, “body pieces were everywhere,”

There have been 16 accidents at the crossing since 1976, involving 3 fatalities, before the bus collision. The crossing has bells, a barrier, and several signs. However, one local resident considers the crossing a safety hazard, since it’s so steep.

It’s very likely that there will be some sort of legal action as a result of this accident. For one, either the train or bus company, or both, may be held liable by one of the victims or their families. The driver may be at fault as well. Whatever the case, the victims will most likely be seeking some sort of compensation for the pain and suffering they’ve experienced as a result of the accident.

If you’ve found yourself the victim of an accident, the best thing you can do, aside from seek quality medical care, is to hire a talented lawyer to represent your interests. They will investigate your situation to the fullest to make sure that all the facts are available. From that information, they will come up with a strategy to help you fight for the compensation you need to get on with your life. Call today for a consultation to see how an attorney in Bastrop can help you.

11-Year-Old Dies After Electrocution Accident in New Jersey

A fun visit with a friend and a boat ride on the lagoon had a tragic ending recently, when an 11-year-old girl died after being electrocuted, according to USAToday. The girl was visiting a friend in Toms River, and they went out on an inflatable boat. They had taken precautions by wearing life jackets, and were being supervised by adults. At one point, the girls grabbed onto the metal handle of a boat lift, and received a shock. One escaped injury completely, while the parents worked hard to administer CPR to keep her alive until emergency services arrived. EMS transported her to Community Medical Center in Toms River, but she sadly passed away in the hospital.

It’s currently not known for sure what caused the boat lift to become energized. It somehow conducted an electrical current, which hit the girls when they touched the metal equipment. Authorities inspected the equipment fully and will hopefully be able to find an answer to prevent any further injuries or fatalities. According to police, the boat lift was installed in 2001, and was compliant with the building code at the time. After the property was sold to the current owner, it came into disrepair as the new homeowners didn’t use it much, nor did they inspect it. Under the dock, there is an electrical junction box, and the suspicion is that this box corroded, and electricity somehow made its way to the metal frame.

While many people in New Jersey are aware of the risks and safety precautions to take on the water, few consider electrocution as something to worry about. However, boats and docks and other nautical equipment do involve electricity, and therefore they come with certain risks. Electrical Safety Foundation International, a nonprofit organization, suggests that even a light current can pass through the body while swimming and incapacitate someone enough to cause drowning.

Swimming near marinas and running boats can be dangerous, and not just from getting caught in propellers. They say that even as little as .5 percent of the power needed for a 60-watt light bulb could paralyze someone. There are reported injuries and deaths near docks caused by electrocution every year. From 1986 to 2013, there were a reported 70 deaths attributed to electrocutions and water. Electrified boat lifts were the culprit in several of them. Having equipment inspected is vital to keep friends and family safe.

Electrocution can cause serious injuries all on its own. When water is thrown into the mix, it can be even deadlier. If you’ve been injured, or a loved one has died in an accident in New Jersey, make sure to contact an attorney to protect your interests. If someone is at fault, they can investigate your situation and make a good case to get you compensation. If an insurance company isn’t paying what you feel they should be, then an attorney can help fight for your rights. Call today to discuss your options.
